Three agencies asked to act
The measure, introduced by National Action Party (PAN) deputy Claudia Caballero, assigns different requests to three agencies: Mexico's Financial Intelligence Unit would trace the funds and identify their ultimate recipients; the federal prosecutor, known as the FGR, would follow up on the audit complaint and act if evidence warrants; and the state auditor would scrutinize Nuevo León's 2025 accounts.
PRI deputies supported the request, which seeks legal follow-up rather than making an accusation. García's party, Movimiento Ciudadano, argued that lawmakers were prejudging the matter. The precise vote tally has not been published.
The resolution does not require the prosecutor to open a criminal case and does not suspend any official or contract. As of November 4, the FGR had not announced whether it had opened a case.
Audit allegations and García's denial
The Auditoría Superior de la Federación (ASF), which audits public spending for Mexico's lower house of Congress, flagged possible triangulation and simulated transactions in its review of the state's 2025 accounts. It identified 7,212 million pesos in payments routed through suppliers, equivalent to about $384 million at 18.7592 pesos per dollar. Triangulation refers here to the use of intermediary companies that makes the money's final destination difficult to trace.
The ASF's complaint arrived at the FGR on October 16. Caballero says the funds passed from suppliers through chains of companies, with some reaching a law firm she links to García's relatives. The ASF has not publicly identified any individual. Its findings are audit allegations, not a court ruling.
The complaint has not been released, leaving the alleged offenses unspecified publicly. Reports also give conflicting amounts for the funds that reached the law firm; no total for those transfers is cited here.
García, who took office in October 2021, represents Movimiento Ciudadano, an opposition party distinct from the governing Morena movement. On August 6, he said he had nothing to hide and was willing to be investigated. He described the law firm's payments as legal fees, said state prosecutors had found nothing illegal about them, and dismissed the opposition's earlier allegations as recycled claims.
Movimiento Ciudadano's leader in the state Congress, Sandra Pámanes, said on November 3 that the ASF review was still underway. She accused PAN and PRI lawmakers of passing political judgment prematurely. García had not responded specifically to the Congress's new request.
Impeachment remains blocked
The audit dispute runs alongside an unfinished impeachment proceeding. Morena politicians filed federal complaints in May concerning payments to a law firm associated with the governor's family. In June, the state Congress's anti-corruption committee voted 6-1 to begin impeachment proceedings, known as juicio político.
Noticias NRT reported that PAN and PRI deputies called on November 3 to revive that process following the ASF findings. The case remains at the evidence-gathering stage, while judicial measures have blocked its advance to the full Congress for a definitive decision.
PRI deputy Perla Villarreal, who serves on the anti-corruption committee, said committees could discuss and vote on the matter. PAN caucus coordinator Carlos de la Fuente also called for pursuing it through criminal channels. Impeachment requires a final vote by the full Congress; no such vote or date has been published.
A dispute ahead of the 2027 election
Nuevo León's next local elections are scheduled for June 6, 2027, according to Wikipedia's entry on the election. Voters will select a governor for six years, all 42 state legislators and municipal governments in each of the state's 51 municipalities. The state constitution bars anyone elected governor in an ordinary or special election from holding the office again, ruling out another term for García.
Expansión Política identifies three leading potential successors: García's wife, Mariana Rodríguez, whom Movimiento Ciudadano is backing as a prospective contender; Clara Luz Flores of Morena; and Adrián de la Garza, a possible candidate for a PRI-PAN alliance. These remain prospective candidacies. Morena designated Flores its state coordinator and presumptive nominee on September 28, 2026, setting her on course for another gubernatorial bid after her 2021 campaign, according to the election entry.
The state has about 6 million residents. Expansión Política describes it as Mexico's economic engine, accounting for 8% to 10% of national GDP, and notes that it is among 17 states due to elect governors on the first Sunday of June 2027.
Legal status and business exposure
Monterrey is a major manufacturing base serving American customers. For US companies and lenders dealing with the state, the unresolved question is whether the federal prosecutor will open a case. The publicly disclosed ASF findings identify no foreign company.
For now, the congressional request remains a political and legal development, not proof of misconduct by an official or business. No charges have been filed, and García retains the presumption of innocence. The decision on whether the audit complaint proceeds as a criminal case rests with the FGR.
